DOG ENTRY WAIVER, RELEASE OF LIABILITY, AND INDEMNITY AGREEMENT

By bringing a dog onto the property, I acknowledge and agree to the following:

I am at least 18 years old and am either the legal owner of the dog or have the owner’s permission and authority to bring the dog onto the property.

I represent that the dog is properly licensed and vaccinated as required by law and, to the best of my knowledge, has no history of biting, attacking, fighting, threatening, lunging at, or displaying aggressive behavior toward any person or animal.

I understand that concerts, crowds, loud music, children, food, unfamiliar people, and other dogs may cause unpredictable behavior. I voluntarily assume all risks associated with bringing the dog onto the property, including dog bites, attacks, fights, scratches, falls, tangled leashes, escapes, injuries, illness, property damage, veterinary expenses, medical expenses, and injury to or death of any person or animal.

The dog must remain on a secure, non-retractable leash no longer than four feet and under my direct physical control at all times. I will not leave the dog unattended, tie it to any object, permit a child to act as its primary handler, or allow it to approach another dog without the other handler’s permission.

I agree to immediately remove the dog from the property if requested by event staff for barking, growling, lunging, aggression, fighting, lack of control, disruption, sanitation concerns, or any other safety-related reason. Permission for the dog to remain on the property may be revoked at any time.

To the fullest extent permitted by California law, I release, waive, and forever discharge the Gandolfo Family Trust, Gandolfo Family Market & Deli, The Lot, Gregory William Gandolfo individually, every other Gandolfo family member, and each of their trustees, beneficiaries, owners, officers, employees, agents, volunteers, contractors, vendors, performers, event organizers, insurers, successors, and assigns from any and all claims, demands, damages, losses, liabilities, expenses, lawsuits, or causes of action arising from or relating to:

  • My dog’s presence or conduct;

  • Any dog bite, attack, fight, scratch, escape, injury, or property damage;

  • Any interaction involving my dog, another dog, another animal, or another person;

  • The failure to supervise, separate, restrain, exclude, or remove any dog;

  • The condition, operation, management, or supervision of the property or event; and

  • Any injury to or death of a person or animal.

This release expressly includes claims arising from the ordinary negligence of any released party. It does not release conduct that cannot legally be waived under California law.

I accept complete responsibility for the dog and for every injury, loss, expense, or item of damage caused or allegedly caused by the dog.

I agree to defend, indemnify, reimburse, and hold harmless all released parties from every claim, lawsuit, demand, judgment, settlement, penalty, medical expense, veterinary expense, property-damage claim, attorney’s fee, court cost, or other expense arising from or relating to the dog’s presence or conduct, including claims made by another attendee, dog owner, child, employee, vendor, performer, governmental agency, or other third party.

My duty to defend and reimburse the released parties applies even when it is alleged that the ordinary negligence of a released party contributed to the incident, to the fullest extent permitted by law.

I agree to immediately report any bite, attack, fight, injury, escape, threatening behavior, or property damage to event management. I will provide my identification, contact information, dog information, vaccination information, and liability-insurance information upon request.

I authorize event personnel to take reasonable emergency action to protect people, animals, and property, including separating dogs, removing the dog, contacting emergency services, law enforcement, animal control, or veterinary services. I accept responsibility for any resulting costs.

I understand that the released parties have not evaluated or certified the temperament of any dog and do not guarantee the safety of any dog, person, activity, or area of the property.

This agreement is governed by California law. If any provision is found unenforceable, it shall be limited or removed only to the minimum extent necessary, and the remaining provisions shall remain effective.
